SELLER RESOURCES

TITLE

If there is a divorce (active or final), bankruptcy, death, name change, or any other potential title issues associated with this property, pleases notify our office immediately. We may require additional information and/or copies of documents to ensure title is clear and conveyable.

TRUST

If you are selling the property under your Trust, please provide our office with your documents (i.e., Trust, any and all amendments to the Trust, and/or Certification of Trust).

ESTATE

If you are selling the property under an Estate, please provide our office with your documents (i.e., Letters of Testamentary or Letters of Administration, Will, and death certificate).

CORPORATION

If you are selling the property under your corporation, please
provide our office with your documents (i.e., by-laws, any amendments, good standing letter (if out of state), and signing authority).

LLC

If you are selling the property under your limited liability company, please provide our office with your documents (i.e., operating agreement, any amendments, good standing letter (if out of state), and signing authority).

SOCIAL SECURITY #

FEDERAL TAX ID #

Federal and State law requires that we
securely obtain your social security number(s), or Federal tax ID number(s) if you are selling in a corporation, limited liability company, Estate, or Trust for reporting purposes. We are unable to obtain a/any mortgage payoff(s) or provide tax forms at closing without receiving. We do NOT release your social security number/Federal tax ID number to anyone but the State of Georgia and/or IRS, required by law.

OUT OF STATE SELLERS

If you are no longer a resident of Georgia as of the date of
closing, you may be subject to a 3% state withholding tax per the Georgia Department of Revenue. Please notify our office as soon as possible so that we can provide you with the appropriate Georgia tax forms to determine if tax will be owed.

NON-US CITIZEN SELLERS

If you are a non-US citizen, you may be subject to a
Foreign Investment in Real Property Tax Act (FIRPTA) 10%-15% federal
withholding tax per the IRS. Please notify our office as soon as possible so that we can provide you with the appropriate FIRPTA tax form(s) to determine your withholding amount.

PAYOFFS

In order for our office to request the payoff statement(s), we will need
the lender’s company name, phone number, account/loan number, and your social security number/Federal tax ID number. If you have an open line of credit, even if it has been paid in full with a $0 balance, please notify our office. Please note, some lenders take up to 10 business days to provide us with the statement, so please provide the information as soon as possible. If your lender requires our office to prepare and file the cancellation/release, additional fees may occur on
your settlement statement.

HOMEOWNER'S ASSOCIATION

Please provide our office with the contact name, phone number and/or email address to the HOA. We are required to receive their fees prior to closing. Please note, some associations require us to pay in advance.
This will be reimbursed to our office at closing and reflected on the settlement statement.

NOT ATTENDING CLOSING OPTIONS

Please notify our office as soon as possible if you
are unable to attending closing here at our office. We have a couple of different options you can choose from, ranging between $35-$315. Any and all fees will be taken from your proceeds, reflected on your settlement statement.

CLOSING PROCEEDS

We can provide you with a same day wire transfer (no
additional fees) or a check at closing. Please note, if you are selling under your corporation, limited liability company, Estate, or Trust, we are required to disburse funds directly to the corporation, limited liability company, Estate, or Trust. We cannot disburse funds to you individually.

CONTINGENT CLOSINGS

If you are buying property and would like your sale proceeds
to be sent directly to the title company/law firm handling your purchase, please provide us with their contact information so that we can obtain their wire instructions securely.
